Terms of Service

These Terms of Service govern your use of OpenHousePro. By accessing or using the Platform, you agree to these Terms.

1. Platform Purpose

OpenHousePro is a technology platform designed to facilitate introductions, communications, and coordination between users for real estate-related agent requests, service requests, assignments, messaging, service provider referrals, developer opportunities, developer incentives, and related collaboration workflows.

2. Independent Platform

OpenHousePro is a technology platform that facilitates introductions and communications between users.

OpenHousePro is not a brokerage, real estate company, mortgage company, developer, inspection company, contractor, legal service provider, financial institution, payment broker, employer, or professional regulator.

OpenHousePro does not provide real estate services, brokerage services, financial services, mortgage services, inspection services, contractor services, legal services, developer services, accounting services, tax services, insurance services, or professional regulatory services.

3. Eligibility

Users must be at least 18 years old, provide accurate registration information, and hold any licence, approval, authorization, insurance, brokerage permission, or professional qualification required for the services they offer, request, refer, or perform.

4. Independent Relationship

The Platform only facilitates introductions, communication, and coordination between independent users. Agreements regarding compensation, duties, service quality, access, timing, cancellation, brokerage approval, professional responsibility, referral arrangements, developer opportunities, incentive programs, and business outcomes are solely between participating users, brokerages, developers, service providers, or other applicable third parties.

5. Brokerage And Regulatory Compliance

Users are responsible for complying with provincial regulations, brokerage policies, MLS rules, advertising regulations, privacy obligations, consumer-protection rules, licensing obligations, referral rules, compensation rules, developer marketing rules, anti-spam rules, and any other professional requirements that apply to their activities.

6. No Verification Of Credentials

OpenHousePro does not independently verify, certify, endorse, or guarantee the accuracy of user-submitted licensing information, brokerage affiliations, credentials, certifications, insurance coverage, experience, references, service quality, professional qualifications, authority, availability, payment ability, performance, or conduct.

Users are solely responsible for conducting their own due diligence before entering into any business relationship, referral relationship, developer opportunity, service engagement, assignment, or other collaboration.

7. Requests, Assignments, And Compensation

Users are responsible for reviewing request details, confirming compensation, confirming access instructions, confirming brokerage permissions, and documenting any changes before work begins. The Platform may help record workflow events, but it does not guarantee payment, resolve commission disputes, resolve referral disputes, or replace written agreements required by brokerages, developers, service providers, regulators, or other third parties.

8. Service Provider Disclaimer

OpenHousePro acts solely as a technology platform facilitating introductions and communications between users.

OpenHousePro does not endorse, certify, guarantee, warrant, supervise, screen, insure, or verify any service provider listed, recommended, referred, reviewed, contacted, or engaged through the Platform.

OpenHousePro does not guarantee service quality, licensing status, insurance coverage, professional qualifications, performance, results, pricing, availability, safety, or suitability of any service provider.

Users are responsible for evaluating and selecting service providers at their own discretion and risk.

9. Developer Opportunity Disclaimer

Developer opportunities, incentive programs, project information, promotional materials, lead programs, and related communications may be provided by third-party developers or their representatives.

OpenHousePro does not guarantee availability, accuracy, eligibility, incentive value, program continuation, developer participation, compensation, referral fees, qualification, access, selection, conversion, or business outcomes.

Submitting interest does not guarantee qualification, participation, compensation, referral fees, access, selection, contact, or approval by a developer.

10. Contact Sharing Consent

By selecting "I'm Interested", "Interest Submitted", or any similar action relating to a Developer Opportunity or Developer Incentive, users consent to the sharing of their contact information with the applicable developer for follow-up purposes.

Developer interest submissions follow this rule: one agent plus one developer opportunity equals one interest submission only. After an agent submits interest, the action is recorded, contact information may be shared with the developer, and the button may become disabled or show "Interest Submitted". Duplicate submissions for the same developer opportunity may be blocked.

11. Messaging And Communications

Users are responsible for communications conducted through the Platform. Messages and notifications may be used to coordinate requests, assignments, cancellations, updates, reviews, referrals, developer opportunities, support, legal notices, security alerts, operational notices, email notifications, and push notifications.

Users may manage communication preferences where applicable. Certain account, legal, security, transactional, and operational notifications may still be delivered when necessary for platform operation, account safety, compliance, or service delivery.

Communications may be monitored, retained, or reviewed for security, support, compliance, dispute, notification delivery, or abuse-prevention purposes where permitted by law.

12. User Conduct

Users may not misrepresent identity, credentials, licensing status, brokerage affiliation, availability, experience, insurance coverage, references, service quality, developer affiliation, incentive authority, or professional authority. Users may not harass others, misuse client information, interfere with another user's business, submit false reviews, submit false referrals, submit misleading developer information, or violate applicable laws, brokerage rules, developer rules, service provider obligations, or platform policies.

13. Reviews And Ratings

Reviews and ratings must be based on genuine completed collaborations or referral experiences. Users may not submit fake, misleading, defamatory, retaliatory, or abusive reviews. Auratic Canada Inc. may hide, remove, or investigate reviews that appear inappropriate or unreliable.

14. Intellectual Property

All Platform software, branding, logos, design, and original content are owned by or licensed to Auratic Canada Inc. Users retain responsibility for content they submit and must have the right to share it.

15. Limitation Of Liability

To the maximum extent permitted by applicable law, OpenHousePro and Auratic Canada Inc. shall not be liable for business losses, missed opportunities, compensation disputes, commission disputes, referral disputes, service quality issues, developer decisions, failed transactions, regulatory violations by users, misrepresentations by users, payment issues, cancellation issues, property access issues, review disputes, notification failures, communication failures, lost data, lost profits, loss of goodwill, or any issue arising from use of the Platform or interactions between users, developers, service providers, brokerages, or other third parties.

All business relationships and agreements remain solely between the participating parties.

16. No Warranty

The Platform is provided "as is" and "as available" without guarantees regarding availability, uptime, earnings, matching, request volume, service provider quality, developer participation, successful collaboration, payment, performance, notification delivery, or user conduct.

17. Indemnification

Users agree to indemnify and hold harmless Auratic Canada Inc. from claims, losses, damages, costs, and expenses arising from misconduct, inaccurate information, regulatory violations, brokerage disputes, developer disputes, service provider disputes, privacy breaches, payment disputes, referral disputes, notification disputes, or interactions with other users or third parties.

18. Suspension And Termination

Auratic Canada Inc. may suspend, restrict, or terminate access for violations, suspected fraud, abuse, security concerns, legal requirements, inaccurate information, repeated disputes, or conduct that may harm the Platform or other users.

19. Governing Law

These Terms are governed by the laws of British Columbia and the applicable laws of Canada.
